Terms of Service

These Terms of Service ("Terms") govern your access to and use of MyWaiverSoft, a platform operated by Church Vine LLC ("Company," "we," "us," or "our"). By accessing or using the platform, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using any part of the MyWaiverSoft platform, you confirm that you are at least 18 years old, have the authority to enter into these Terms on behalf of your organization if applicable, and agree to comply with all applicable laws.

2. Description of Service

MyWaiverSoft provides software tools for Maryland Autism Waiver service providers, including session documentation, staff management, scheduling, transportation coordination, billing readiness, and compliance tracking. The platform is provided on a subscription basis.

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access at support@mywaiversoft.com.

Consent to receive SMS text messages is voluntary and is not a condition of purchase, employment, account creation, receipt of services, or use of MyWaiverSoft.

If you separately opt in to SMS notifications, you may receive account alerts, schedule changes, transportation updates, and other operational messages from MyWaiverSoft (Church Vine LLC). Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe at any time or HELP for assistance. No mobile information or SMS consent data will be shared with third parties for marketing or promotional purposes.

6. Privacy

Your use of the platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. We handle protected health information (PHI) in accordance with HIPAA and applicable Maryland regulations.

7. Subscription and Payment

Access to paid features requires an active subscription. Subscription fees are billed in advance. You authorize us to charge your payment method on a recurring basis according to your selected plan. Cancellations take effect at the end of the current billing period. No refunds are provided for partial periods.

8. Intellectual Property

All rights in the platform, including software, trademarks, and documentation, are owned by Church Vine LLC. You are granted a limited, non-exclusive, non-transferable license to use the platform for its intended purpose during your subscription term.

9. Data Ownership

You retain ownership of all data you upload or create within the platform, including client records and staff information. We will not access, use, or disclose your data except as necessary to provide the service or as required by law. Upon termination, you may export your data within 30 days.

10. Limitation of Liability

To the maximum extent permitted by law, Church Vine LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform. Our total aggregate liability shall not exceed the amount paid by you in the 12 months preceding the claim.

11. Disclaimer of Warranties

The platform is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted or error-free.

12. Termination

Either party may terminate these Terms with 30 days' written notice. We may suspend or terminate your access immediately if you breach these Terms or if required by law. Upon termination, your right to use the platform ceases immediately.

13. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Maryland.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
